Window-kicking woman sentenced to 60 days

A Pennsylvania woman accused of kicking out the window of a sheriff’s car was sentenced to 60 days in jail, placed on probation and told to pay for the damaged vehicle after she pleaded no contest Wednesday to vandalism and resisting arrest.

Heather Carey, 41, of Springfield, PA, appeared Wednesday in San Fernando Superior Court where she entered her plea.

After entering her plea, Carey was placed on three years summary probation, sentenced to 60 days Los Angeles County jail, susceptible to search and seizure conditions, and must make restitution in the amount of $600 to be paid to LASD for the broken patrol car window, Ricardo Santiago, spokesman for the Los Angeles County District Attorney’s Office said.

She was also ordered to stay away from and “do not contact” Sean Kenny, who was arrested at the same time Carey was arrested.

Prosecutors dropped a second count of resisting arrest filed against Carey as part of their plea agreement.

Kenny, who was charged with one misdemeanor count of being under the influence of a CNS stimulant and who also appeared in San Fernando Superior Court Wednesday, pleaded not guilty, Santiago said.  He was ordered to appear back in court Friday.

Kenny and Carey were arrested on the weekend following a fist fight inside a Castaic fast food restaurant that led to the woman kicking out the window of a sheriff’s car allegedly then crawling through it in a bid to get away appeared in court Wednesday.

Deputies learned of the incident when someone at a Castaic restaurant called them to report a fight.

“On Jan. 14,  at 3 p.m., witnesses reported that a man and a woman had a physical fight in a fast food restaurant in the 27700 block of Lake Hughes Road, Castaic, and then left on foot,” Cambra said.

“Deputies responded and located Heather Carey and her boyfriend Sean Kenny walking in the area. Both had injuries and described being assaulted by the other one,” she said.

“While handcuffed and in the patrol car, suspect Carey, used her foot to kick the side window of the patrol car out,” Cambra said. “She then attempted to climb out of the car through the open window.”
