A cyclist arrested two months ago in connection with an apparent case of road rage – or, specifically, driveway rage – for allegedly throwing something at a motorist’s car has been ordered to undergo a psych evaluation.
Ferdinand Abergas Marcelo, a 36-year-old transient on a bicycle, was arrested on Feb. 5 following a confrontation he allegedly had with a motorist, culminating in the cyclist allegedly throwing something at the motorist’s car.
Marcelo appeared last week in San Fernando Superior Court were he was ordered to undergo a mental health assessment under section 1368 of the California Penal Code.
Court is expected to receive an update on those mental health proceedings on May 9, Ricardo Santiago spokesman for the Los Angeles County District Attorney’s Office told The Signal Monday.
Marcelo was arrested on suspicion of vandalism resulting in a monetary loss believed to be more than $400, a felony.
“The victim was pulling out of a commercial driveway on the 26100 block of Bouquet Canyon Road, near Cinema Drive, when the suspect was riding his bicycle on the sidewalk,” Lt. Ignacio Somoano of the Santa Clarita Valley Sheriff’s Station told The Signal on Feb. 7.
“The suspect threw an item at the victim’s cars causing damage,” he said.
“The victim called 911 while trying to maintain a visual on the suspect. Deputies located the suspect in a nearby area and arrested him for vandalism,” Somoano said.
The felony charge cited by arresting deputies could result in a one-year sentence or a fine of up to $10,000 upon conviction, according to the California Penal Code.
Marcelo’s bail was set at $50,000.
