Kudos to Federal Judge Maame Ewusi-Mensah Frimpong for recognizing the overreach in the proposed injunctive relief related to the Chiquita Canyon Landfill. The current proposal — $4,000 per month for selected households in downwind communities such as Castaic — lacks the specificity needed to deliver meaningful support.

The plan fails to address a critical question: When and how will funds be disbursed to facilitate relocation? Consider a household that chooses to move and secures a rental. The landlord requires first and last month’s rent plus a $300 cleaning deposit. If the household must rely on monthly disbursements of $4,000, they won’t have sufficient funds to sign a lease until the third payment arrives. That means more than two months of the six-month assistance period could pass before the family breathes any relief. 

Monthly disbursements would undermine the intent of the program. A more effective plan would be to front-load support: two lump-sum payments of $12,000, or one initial payment of $12,000 followed by $4,000 monthly for the final three months. This approach would empower families to act promptly, securing better housing without delay. 

Practicality must guide any injunctive relief. Otherwise, we risk offering symbolic aid that fails to meet the health and comfort needs of affected residents.
